Terms of Service

Effective Date: June 26, 2025

These Terms of Service (“Terms”) govern your access to and use of the Drumable website, services, content, and features (collectively, the “Service”). By accessing or using Drumable, you agree to be bound by these Terms.

1. Eligibility

Drumable is for users of all ages. Users under 18 must have consent from a parent, legal guardian, or authorized teacher. Users under 13 may only use the Service under direct adult supervision, and Drumable collects limited personal information from them only after obtaining verified parental consent.

Teacher Admin members may create student accounts, including for users under 13. They must obtain verifiable parental consent and provide a parent or guardian email. Drumable will send a consent request email, and the student account remains inactive until the parent gives approval. Consent actions are logged.

2. Account Registration

You must create an account to access most features. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity under your account.

3. Memberships and Payments

Drumable offers subscription-based memberships. By subscribing, you authorize us to charge your payment method on a recurring basis until canceled. Free trials may be offered, and trial users must provide valid payment information.

You can cancel your subscription at any time. Refunds are not guaranteed. You are responsible for any taxes that apply to your purchases.

4. Use of the Service

You agree to use Drumable only for lawful purposes and in accordance with these Terms. You may not:

  • Share your account with others
  • Attempt to reverse-engineer or interfere with the Service
  • Upload harmful or illegal content

Drumable reserves the right to suspend or terminate accounts for violations.

5. Content and Intellectual Property

All content provided by Drumable, including sheet music, books, and instructional tools, is the property of Drumable or its licensors. You may not reproduce, distribute, or modify content without permission.

Users, including teachers, students, and regular account holders, may upload content (“User Content”) such as files, images, and other instructional materials. You retain ownership of your uploaded files. You are solely responsible for any content you upload and for ensuring that it does not violate any applicable laws or third-party rights.

Users may also choose to make their uploaded content publicly accessible to other Drumable members. Content will only be shared in this way if the user explicitly selects to make it publicly available within the Drumable platform. By doing so, you grant Drumable a non-exclusive, royalty-free license to store, display, and distribute the selected content to other Drumable members within the platform. You agree that Drumable may feature or highlight such content at its discretion.

6. User Conduct and Community Guidelines

Respectful communication and behavior are required. Harassment, abuse, or misuse of the platform may result in account suspension or termination.

7. Disclaimers and Limitation of Liability

Drumable is provided “as is.” We do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent allowed by law, Drumable is not liable for any indirect or consequential damages.

8. Privacy

Your use of Drumable is subject to our Privacy Policy, which describes how we collect and use your information. Drumable may collect information such as usernames, parent or teacher contact details, student progress data, uploaded files, and account activity history. This information is used solely for educational purposes, user support, and improving the Service. We do not sell or share personal information with third parties for advertising purposes.

9. Changes to the Terms

We may update these Terms at any time. We will notify you of significant changes. Continued use of the Service after changes means you accept the new Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. You agree that any dispute arising from or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of such courts.
